BY ACCESSING OR PARTICIPATING IN THE FASHWIRE REWARDS PROGRAM AND PITCH COMPETITIONS, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED BY REFERENCE. THE OFFICIAL CONTEST RULES

These Terms of Use apply to your access to, and participation in, the FashWire Pitch Competitions (“FashWire Competitions") which is operated by The Wires Platforms, Inc. (doing business as FashWire). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with FashWire for other products and services.

FashWire reserves the right to change, modify and/or eliminate FashWire Competitions and/or all or any portion of these Terms of Use or any policy, FAQ, or guideline pertaining to FashWire Competitions at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to fashwire.com and you waive any right you may have to receive specific notice of such changes or modifications.

Your participation in FashWire Competitions confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies and FAQs frequently to understand the terms and conditions that apply to FashWire Competitions. If you do not agree to the Terms of Use, you must stop participating in FashWire Competitions.

The FashWire Competitions program is intended for personal use only. Commercial use is prohibited. This program is not targeted towards, nor intended for use by, anyone under the age of 18.

Please read the Privacy Policy carefully to understand how FashWire collects, uses and discloses information about customers and how to update or change your personal information and how we communicate with you.

GENERAL PRIZE CONDITIONS

The prize winners shall be solely responsible for any required or applicable federal, state, provincial and/or local taxes and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. The potential prize winners must execute a Prize Acceptance Form (“Prize Claim Documents”). If a winner fails or refuses to sign and return the Prize Claim Documents within seven (7) days of prize notification (or a shorter time if required by exigencies), the winner may be disqualified and an alternate winner may be selected. Sponsor reserves the right to withhold a prize for any breach of the Official Rules. If there is a tie between two winners, any cash prizes or equivalent of cash prizes will be split evenly between the winners. No substitution of prizes for cash or other goods or services is permitted.

PUBLICITY RELEASE

By participating in the Contest, each entrant irrevocably grants FashWire and its brands and their respective successors, assigns and licensees, the right to use such entrant’s name, likeness, biographical information and Submission in any and all media for any purpose, including without limitation, advertising and promotional purposes as well as in, on or in connection with the Website or the Contest or other promotions, and hereby release the Promotion Entities from any liability with respect thereto.

GENERAL TERMS

All prizes are non-transferable. FashWire reserves the right to substitute a prize of similar value. FashWire cannot be held responsible for unforeseen cancellations or delays of concerts/events or transportation caused by weather, promoter or performer. Void where prohibited by law. All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the judges.

ODDS

The odds of winning depend on competition.

WINNER NOTIFICATION

Winners will be notified via FashWire email, press release and/or media release. Prizes must be accepted in writing by the winners within thirty (30) days of notification to the winner. Otherwise, failure to accept the prizes by the deadline will result in the forfeiture of the prize, which shall remain the property of The Wires Platforms.

As a condition of entering a contest, Qualifiers must agree that upon winning, they will consent to the use of their name, likeness, and all verbal and written communications with FashWire for publicity purposes.

CASH PRIZES

All cash winnings require an IRS Form W-9 or International Form W-8 BEN to be filled out. Once received, the cash winnings will be sent to your company's PayPal account within 180 business days.

ELIGIBILITY

Employees of The Wires Platforms and their advertising agencies, affiliates, contest sponsors, employees and immediate families of each are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.

CONDITIONS

FashWire assumes no liability for liability, damages, situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. FashWire, all participating co-sponsor companies and their advertising and promotional agencies, affiliates thereof, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest. As a condition of entering a contest, participants may be required, upon winning, to sign a release form and affidavit of eligibility to claim their prize. Failure to do so will result in forfeiture of the Qualifier’s right to claim or receive the prize. All appropriate information in required fields must be filled out or Qualifiers will be disqualified. Qualifiers who attempt to register to participate on FashWire websites may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.

LIMITATIONS OF LIABILITY

FashWire assumes no responsibility to computer or communications errors or any incorrect or inaccurate information. Any problems with the internet or email are not FashWire responsibility.

FashWire reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of FashWire management if world events, the national mood, or public safety so warrant. FashWire reserves the right to disqualify any winner if the contest rules have been violated in any way. FashWire reserves the right to amend the rules to any contest at any time. All decisions of FashWire are final. Although FashWire will make reasonable efforts to conduct its contests substantially as announced or advertised, FashWire reserves the right to change or modify the rules of its contests as exigent circumstances may require. In such cases, FashWire will amend the rules for that contest and broadcast the amended rules as promptly as possible. In such case, the contest will be conducted in accordance with the amended rules.

All giveaways and contests are void where prohibited by law. All local, state, federal and international regulations apply.

These FashWire Competitions complement the FashWire Terms of Use. In the event of any conflict between the FashWire Terms of Use and these FashWire Competitions, the FashWire Terms of Use Conditions control.

There are no membership fees associated with FashWire Competitions. Likes accumulated under the program are promotional and have no cash value.

Your Likes and your account under FashWire Competitions are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose.

You may have only one (1) FashWire account that is personal to you to get Rewards.

Without notice to you, FashWire reserves the right to suspend and/or terminate your account and/or your participation in FashWire Contest and Rewards if FashWire determines in its sole discretion that you have violated these Terms of Use, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful.

FashWire may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in FashWire Competitions is terminated, then all accumulated Likes in your account posts are void.

FashWire reserves the right to terminate, discontinue or cancel the FashWire Competitions program at any time and in its sole discretion without notice to you.
